Rhode Island takes a lean, statute-first approach. Most day-to-day governance happens under the Condominium Law (34-36.1) for post-1982 communities (with older condos still under the 1963 Act, 34-36), while single-family “HOAs” often rely on their declarations plus the Nonprofit Corporation Act (7-6). There’s no condo ombudsman or mandatory ADR program at the state level; enforcement is largely by notice-and-hearing, then courts. Two areas see more state involvement: (1) mobile/manufactured home parks (DBR licensure and tenant protections), and (2) record-keeping/recording—notably 2024’s law requiring condos to record bylaws and rules with local land records.
At a glance
- Condominiums: Primary law is Ch. 34-36.1 (post-1982); some legacy condos under Ch. 34-36.
- “HOAs”: No standalone HOA act; typically governed by recorded covenants + Nonprofit Corporation Act (7-6).
- Cooperatives: Organized under Cooperative Housing Corporations (7-6.1).
- Mobile/Manufactured parks: Ch. 31-44 (+ 31-44.1 for lot-rent increases).
- New (2024): Condos must record bylaws & rules in municipal land records (S2647). See Popular Sections.
- Managers: No RI-specific CAM license; property management functions can require a real estate broker’s license (5-20.5).
