Idaho Community Association Laws
HOAs (Title 55, Ch. 32), Condominiums (Title 55, Ch. 15), Manufactured Home Parks (Title 55, Ch. 20), corporate acts (Title 30), no CAM licensing/oversight. Reference hub
Idaho’s approach is light on bureaucracy and heavy on statutes. The 2022 Homeowner’s Association Act (Title 55, Ch. 32) pulled scattered HOA rules into one chapter and added clearer duties on open meetings, financial disclosures, notice, and due process—while preserving strong owner rights on rentals, solar, flags, and political signs. Unlike Florida, there’s no state HOA regulator or CAM license; enforcement is mostly by members and the courts. Net effect: predictable if you follow procedures—minimal red tape, but fewer state referees.
At a glance
- HOAs: Title 55, Ch. 32 (open meetings, disclosures, due process, liens; explicit protections for rentals/solar/flags/signs).
- Condominiums: Title 55, Ch. 15 (classic condo act; liens, governance via docs).
- Manufactured Home Parks: Title 55, Ch. 20 (rent notices, terminations, resident associations, ADR).
- Corporate form: Nonprofit corps under Title 30, Ch. 30; some associations use Business Corp Act (Ch. 29).
- Managers: Idaho does not license CAMs or regulate HOAs via an agency; IREC regulates only real estate licensees.

Administrative Rules (IDAPA)
HOA/Condo-specific rules
Idaho has no HOA/condo-specific administrative rules or state oversight office. The Idaho Real Estate Commission (IREC) regulates only real estate licensees and states it does not regulate property managers or homeowner associations.
Community Association Managers — Licensing
Is a CAM license required?
- No. Idaho does not license CAMs and does not regulate HOAs or property managers via IREC.
- Real estate broker/salesperson licensing applies only when performing licensed brokerage activities (not routine HOA management). For license topics, see IREC.
Context
- Industry references consistently note Idaho’s no-license stance for property managers/CAMs. Use contracts and disclosures to set standards.
Governing Documents & Overlays
- Governing documents: Articles, recorded plats/maps, Declaration/CC&Rs, Bylaws, Rules/Resolutions. Corporate procedure via Title 30.
- Owner protections in statute: Rentals (55-3211), solar (55-3208), political signs (55-3209), flags (55-3210).
- Manufactured housing: 90-day rent-change notice; grounds for termination; resident associations; ADR.
- Disputes: Typically private counsel/courts; no Idaho HOA ombudsman or ADR program specific to HOAs.
