Arkansas Community Association Laws
Condos (Horizontal Property Act, Title 18 Ch. 13), nonprofit corporate procedures (Title 4 Ch. 33), landlord-tenant (Title 18 Ch. 17), manufactured housing rules & licensing. Reference hub
Arkansas takes a light-touch approach. Condominiums run on an older, concise Horizontal Property Act while most single-family communities lean on their recorded covenants and the Nonprofit Corporation Act for board procedures, meetings, proxies, and records. There’s no condo/HOA ombudsman or state arbitration track here; oversight is largely local and document-driven. Manufactured-housing is the exception, with state health rules for parks and an active Manufactured Home Commission. Recent bills and 2025 updates to the Horizontal Property Act aim to modernize finances and administration without building a heavy regulatory superstructure—predictable if you follow the bylaws, but owner protections depend heavily on what your documents say.
At a glance
- HOAs / POAs: No single HOA statute; rely on recorded CC&Rs + Nonprofit Corporation Act (Title 4, Ch. 33) for meetings, proxies, ballots, records.
- Condos: Horizontal Property Act (Title 18, Ch. 13); updated in 2025 by Act 516.
- Co-ops: No housing-cooperative act; general Cooperative Associations (Title 4, Ch. 30) or nonprofit forms are used.
- Manufactured Housing: Landlord-tenant (Title 18, Ch. 17) + health/park rules; licensing via Manufactured Home Commission.
- Corporate form: Nonprofit (4-33) most common; some use Business Corporations (4-27).

Administrative Rules (state agencies)
Arkansas has no condo/HOA-specific administrative code like Florida. Manufactured-housing is regulated by the Department of Health and the Manufactured Home Commission.
Condos
- None. Follow the Horizontal Property Act and recorded bylaws.
HOAs / POAs
- None. Use Nonprofit Act for procedure, plus your covenants/bylaws.
Management / Licensing
Is there a CAM license?
- No standalone HOA/condo “CAM” license. Association admin is typically corporate/contractual.
- Property management licenses (2025): AREC now recognizes Property Management Broker and Property Management Associate licenses under the Real Estate License Law. Activities crossing into brokerage/property management may require licensure.
