Oklahoma Community Association Laws

HOAs (Real Estate Development Act, 60 §§851–858), Condominiums (Unit Ownership Estate Act, 60 §§501–530), corporate acts (18 O.S.), landlord–tenant (41 O.S.), OREC licensing (59 O.S.). Reference hub

Oklahoma takes a light-touch, court-first approach to community associations. HOAs are organized under the Real Estate Development Act and rely heavily on recorded covenants and corporate law; condominiums run on the older Unit Ownership Estate Act with detailed (but compact) rules for assessments, liens, and records. There’s no state condo/HOA ombudsman or arbitration program, and there are no association-specific administrative codes—most oversight comes from judges and from how well your governing documents are drafted and followed. If a third-party firm manages the community for a fee, licensing typically flows through the Oklahoma Real Estate Commission’s real-estate framework rather than a separate “CAM” license.

Administrative Rules & Related

Oklahoma has no condo/HOA-specific administrative code. Related rules apply to licensed brokerage/property-management activity.

Community Association Managers — Licensing

Is a separate “CAM” license required?

  • No dedicated CAM license. Many paid management activities (leasing, negotiating, advertising, handling trust funds) are regulated as real-estate brokerage services under the Oklahoma Real Estate License Code.
  • Such activities generally require licensure through the Oklahoma Real Estate Commission (OREC).

Governing Documents & Overlays

  • Core docs: Articles, recorded plats, CC&Rs/Declaration, Bylaws, Board Rules/Policies, Resolutions.
  • Federal overlays: Fair Housing Act, ADA (where applicable), FDCPA (collections), FCC OTARD (antennas), etc.
  • State/local overlays: Zoning/PUD approvals, building/fire codes, county recording practices.
  • Conflicts: Statutes and recorded covenants control; corporate law fills gaps—consult counsel for interpretation.
