Kentucky’s framework is deliberately light on centralized oversight and heavy on procedures. New HOAs fall under the 2023 Planned Community Act (budgets, records, assessments, liens, open board meetings), while condominiums are governed by the 2011 Kentucky Condominium Act and pre-2011 condos by the Horizontal Property Law. There’s no state ombudsman or CAM license; enforcement is largely by owners through corporate governance and the courts. Recent tweaks add guardrails—e.g., a city-initiated receivership tool for failing HOAs and statutory protection for political yard signs—so the overall feel is: procedural and owner-driven, with a few targeted backstops.
